Conditions of Sale
1. ACCEPTANCE AND PRICES
Unless otherwise stated, all orders are accepted on condition that any fluctuation in the cost of materials
may entail adjustment in the price of such order, or portion of order as remains to be completed, and that the price charged will be that ruling at date of dispatch.
2. PAYMENT TERMS
Payment is due within 30 days of the end of the month. Monthly accounts can be arranged by prior arrangement with Turfgrass Enterprises Ltd. If payment is not received by Turfgrass Enterprises Ltd. By the due date, interest of 2½ % will be charged for each month or part month during which the invoice remains unpaid. This rate may fluctuate from time to time.
3. CONDITIONS OF SUPPLY
Turf and associated products supplied by Turfgrass Enterprises Ltd. are sold ex. INTURF production nursery. Whilst Turfgrass Enterprises Ltd. takes every precaution to ensure that their products are of the highest quality and fit for use up to the time of dispatch (or collection), no responsibility can be accepted for deterioration or damage to the turf once the turf has left the INTURF nursery. Furthermore, as control cannot be exercised over the application of Turfgrass Enterprises Ltd. products by the user, any express of implied condition, statement or warranty, statutory or otherwise as to the quality and fitness of Turfgrass Enterprises Ltd. goods, not stated herein, is hereby excluded and any damages recoverable by a customer for whatever cause (including damage for any injury, damage, loss or expense whether caused directly, or indirectly by the condition of the goods) shall not exceed the price paid by the customer for the goods in respect of which that customer claims damage.
4. PRODUCT INFORMATION
All advice and information provided by Turfgrass Enterprises Ltd. whether contained in the literature of Turfgrass Enterprises Ltd. or given by the staff and/or agents of Turfgrass Enterprises Ltd. relating to characteristics and suitability for any particular application, etc., is given for general guidance only and is in no way guaranteed. Customers should satisfy themselves that any specific variety of turf ordered will be suitable for their requirements and an inspection of the turf at the nursery is recommended.
5. SPECIFICATIONS
Turfgrass Enterprises Ltd. advise that any sizes, weights and measurements stated can vary with the moisture content within the product. Whilst Turfgrass Enterprises Ltd. takes every precaution in ensuring that the customer receives at least the total quantity ordered a small proportion of additional turf may be provided thus ensuring any shrinkage is compensated for. Furthermore, sizes, weights and measurements of turf are liable to change without notice.
6. FORCE MAJEURE
No liability will be accepted for any failure of, or delay in, performance which is due wholly or partially, to restrictions by government or other competent authority, strikes, lock-outs, failure in anticipated supplies of raw materials, adverse weather conditions or to any other cause whatsoever beyond the control of Turfgrass Enterprises Ltd.
7. OTHER CONDITIONS OF SALE
By ordering any goods from Turfgrass Enterprises Ltd. you will be deemed to have accepted that these conditions take precedence over any other conditions contained or in any letter, acceptance form, receipt or the like received by Turfgrass Enterprises Ltd. in connection with the goods so ordered and that any such other conditions will not form part of the contract for the sale of such goods.
8. GOVERNING LAW
The interpretation in the performance of these conditions will be governed by the law of England.
NOTES TO RECIPIENT
It is important for lasting results that the turf is laid as early as possible on arrival, or, alternatively, a suitable 'holding' area made available for immediate unrolling of the turf. An adequate water supply must be available on site, particularly in warm dry weather, as copious watering will be necessary immediately after laying and until such time as the turf has re-established in its new environment.
Please ensure that adequate and speedy off-loading facilities are available on site (eg fork-lift truck) if the company has arranged delivery transport, as haulier waiting time can attract additional charges.
